FreeYankee Official Contest Rules & Regulations


No purchase necessary to enter or win.

The FreeYankee Contest ("Contest") is open to legal residents of the 50 United States, the District of Columbia, and Canada (except Quebec) who have Internet access and a valid email account as of the beginning of the Contest period. U.S. residents must be eighteen (18) years of age or older, and Canadian residents must have reached the age of majority in their state or province of residence in order to participate. If selected as a winner, Canadian residents must correctly answer a time-limited mathematical skill-testing question in order to claim a prize. Contest is void in Puerto Rico and where prohibited by law. Employees of FreeYankee and their immediate families (spouses, domestic partners, parents, siblings, children and each of their respective spouses), consultants of FreeYankee, investors of FreeYankee, and affiliates and agents of FreeYankee and their respective employees are not eligible. Participation in this Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules & Regulations ("Official Rules"). Contest is sponsored by FreeYankee Inc. 11778 Election Rd, Suite 260, Draper, UT, 84020 ("FreeYankee"). Please read the following information carefully. All federal, provincial, state, and local laws and regulations apply.

  1. To Enter

    No purchase or obligation is necessary to enter or win. During the "Entry Period" beginning March 1, 2002 (12:00 PM MST) and continuing through December 31, 2002 (11:59 PM MST), you may enter the Contest in either of the following ways:

    (a) Online Entry: You may enter the Contest online by entering at http://www.freeyankee.com. Contest entry is free. After entering, you may invite your friends to enter by filling in their email addresses on the "Tell-A-Friend" page and by sending them personalized email. You automatically receive one entry when you enter. There is no limit to the number of referral entries per entrant during the Entry Period. Any use of robotic, automatic, programmed, or the like entry methods will void all such entries by such methods. FreeYankee does not promote spamming.

    (b) Mail-In Entry: To enter without obligation, legibly hand-write "FreeYankee Online Contest," together with your name, address, email address and age on a 3"x5" card, and mail it to FreeYankee Inc., 11778 Election Rd, Suite 260, Draper, UT, 84020. You will receive one entry per card, and may submit as many mail-in entries as you wish. Illegible, incomplete, or mechanically reproduced mail-in entries will be disqualified.

    Online entries must be received by December 31, 2002, 11:59 p.m. EDT and mail-in entries must be postmarked by December 31, 2002, 11:59 p.m. EDT and received by January 5, 2003. Winners will be notified by email.

  2. Prizes

    One prize will be awarded by combining the entries from all the contest entry pages. Entries will be added together from the PlayStation2, Sharp HDTV
    , Dell Pentium computer, and the tell a friend referral page.  Only one winner will be picked randomly from the combined participants and referral participants from the combined entry pages. All taxes are the sole responsibility of the winner. No substitution, cash equivalent, or transfer of any prize is permitted, except that FreeYankee reserves the right to substitute a prize with one of comparable or greater value if a prize cannot be awarded as advertised for any reason. FreeYankee will not replace lost or stolen prizes. By entering this contest, the participant agrees to all the above terms and conditions noted above. 

  3. Selection of the Winners

    A random drawing will be conducted on or around January 8, 2003 from all eligible entries received from FreeYankee's web site and from at FreeYankee Inc., 11778 Election Rd, Suite 260, Draper, UT, 84020. The drawing will be conducted by FreeYankee judges, whose decisions are final and binding. The winner drawn will receive the prize from the entry page which the participant entered his or her contact information.  This contest shall not be responsible for any damages, taxes, or expenses that the winner might incur as a result of this contest, or receipt and use of the prize. If a winner cannot be contacted, the prize may be forfeited and a new winner will be selected. Prizes are void where prohibited by law and are subject to all federal, state, and local laws and regulations, and provincial local laws. The winners will be notified via email to the email account indicated on the online or mail-in entry within ten (10) business days of the drawing. Odds of winning depend upon the total number of entries received and friend referrals from entries from all contest entries pages. 

    Each winner will have five (5) business days from the date on which the email is sent to accept a prize by means of an email reply to the notification or by U.S. mail to the address specified in the notification. Winners may be required to sign and return a release of liability, declaration of eligibility, and where lawful, a publicity consent agreement all within ten (10) days of acknowledged notification. By accepting and/or using prize, the winner agrees to the use of his/her name, photograph, likeness, biography, voice, and/or video for advertising, trade, or promotional purposes, including online announcement, without additional compensation, unless prohibited by law. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize may be forfeited and an alternate winner will be selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the entered holder of the email account.  

  4. General Terms and Conditions

    Incomplete entries are void. By entering, entrants acknowledge compliance with these Official Rules, including eligibility requirements, and agree to be bound by these Official Rules and the decisions of FreeYankee, which shall be final. Each entrant must be the entered holder of the email account by which each entry is made. FreeYankee reserves the right to verify eligibility qualifications of any winner. United States law governs these Contest rules. FreeYankee makes no warranty or representation as to the accuracy of the information provided on the FreeYankee Web site (accessible at http://www.freeyankee.com) and assumes no liability for any errors or omissions in the content of the Web site. FreeYankee reserves the right to disqualify any person or email address that FreeYankee determines to be in violation of any term contained in these Official Rules. All entries become the exclusive property of FreeYankee and will not be acknowledged or returned. 

    FreeYankee's Privacy Policy applies, Your privacy is maintained with our contest service. You will only receive emails from those interests you sign-up for. If you leave the check boxes blank you will receive no email offers. Any interest groups you do check are always easy to unsubscribe by simply sending a email to unsubscribe@freeyankee.com.  Neither FreeYankee, its agents, representatives, parent companies, affiliates, subsidiaries, legal advisors, advertising agencies, fulfillment agencies, and promotion agencies, nor any telephone network or service providers are responsible for or shall be liable for: (1) late, lost, delayed, damaged, misdirected, incomplete, incorrect or inaccurate, illegible, unintelligible, or postage-due entries, notices, release forms, affidavits, or other correspondence; (2) any computer or network malfunction, electronic transmission error, inaccessibility of any Web site or online service, or any other error or malfunction; (3) any condition caused by events beyond the control of FreeYankee that may cause the Contest to be disrupted or corrupted; (4) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize; or acceptance, possession, or use of the prize; or from participation in the Contest; or (5) any printing or typographical errors in any materials associated with the Contest. FreeYankee reserves the right, in its sole discretion, to suspend or cancel the Contest at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Contest.

  5. Winners List

    For the names of winners, please visit the FreeYankee Web site at http://www.freeyankee.com/winners.html between January 20, 2003 and June 30, 2003.
